Regulating through design

It was in the 1990s that Larry Lessig put into beautiful form an idea that was bubbling up all over the place among people thinking about emerging technology. This was the idea of West Coast Code versus East Coast Code. Both regulated what could and could not be done on various tech-mediated spaces. But East Coast Code sought to do so through law, courts, regulatory agencies and the old paraphernalia of the regulatory state. There are obvious problems in this approach.

I was of the view that all the innovations in regulation were occurring in the developing world (or by scholars working on developing country regulation). I was wrong. It appears that very interesting work is going on at Harvard, possibly in response to the US crisis in regulation: “Weak capture” (defined as special-interest influence compromising “the capacity of regulation to enhance the public interest, but the public interest is still being served by regulation”) may be nearly ubiquitous. But where some net social benefit remains, so does the case for regulation—perhaps modified, but not abandoned. Resorting to analogy again, Carpenter and Moss suggest consulting the history of medicine: Just as physicians once believed that the only effective way to treat infection was to cut it out surgically, it is commonplace today to believe that capture can only be treated by “amputating” the offending regulation.
A death of a scientist is occasion to reflect on the role of behavioral research in the design of telecom devices. It is not so much that Mr. Karlin trained midcentury Americans how to use the telephone. Design for government

Last week I attended a day-long seminar on applying design thinking to government. I wasn’t fully convinced that this was truly novel. But there is no doubt that government does not adequately research the end user of its services. A write up about the event in Mint highlights that aspect: Design thinking denotes an approach to problem-solving, with three distinct aspects. First, users are studiously followed and analysed employing ethnographic tools.
CHAKULA is a newsletter produced by the Association for Progressive Communications (APC). Named after the Swahili word for ‘food’, it aims to mobilise African civil society around ICT policy for sustainable development and social justice issues. The latest issue features an e-interview with LIRNEasia’s CEO Rohan Samarajiva, but it is not the only reason why we thought of highlighting the issue. The content is interesting and very readable. We publish two e-interviews from July 2010 issue here fully, as they are not available on public domain.
